Terms & Conditions

By registering for an account or using this website ("Platform"), all parties agree that the following terms and conditions shall govern all activity on Elite Cattle Auctions, LLC (ECA).

1. Definitions

"Seller" shall mean the owner or authorized agent who consigns one or more lots for sale. "Bidder" shall mean any person who has registered for and received approval to bid on the Platform. "Buyer" shall mean any Bidder who has submitted the successful final bid on a lot.

2. Eligibility

Services are available only to individuals who are competent to enter into a legally binding contract. By registering, you certify that you are at least 18 years of age and possess the legal authority to enter into a valid and binding contract.

3. Bidding & Buyer Responsibility

Placing a bid is a binding, irrevocable offer to purchase. If you are the high bidder at the close of an auction, you are legally obligated to complete the purchase. Once a bid is submitted, it cannot be retracted. Failure to complete payment will result in penalties, including but not limited to account suspension, a non-refundable administrative fee, and any other available legal remedies.

4. Seller Responsibilities

Sellers are responsible for providing accurate, truthful, and complete information for all listings. Misrepresentation of animals is strictly prohibited. Sellers are responsible for coordinating delivery or pickup with the buyer after payment has been confirmed by the Platform.

5. Disclaimer of Warranty

ALL LOTS ARE SOLD AS IS, WHERE IS, AND WITH ALL FAULTS. Elite Cattle Auctions, LLC (ECA) makes no warranty, express or implied, as to the information used to describe any lot. All information is provided by the Seller. It is the Bidder's responsibility to be fully informed as to the nature and condition of any lot purchased. The implied warranties of merchantability and fitness for a particular purpose are specifically waived by the Buyer.

6. Payment Terms & Title Transfer

Payment for all purchases is due from the high bidder **within three (3) business days** of the auction's conclusion. All payments are processed through the Platform. All lots purchased become the property of the Buyer immediately upon the close of the auction, at which point all risk of damage, death, or injury becomes the Buyer's risk.

7. Seller Commission Rates

The following commission rates apply to the final sale price of a listing based on the number of head in the lot. These rates are subject to change.

1 - 5 head 5.00%
6 - 20 head 3.00%
21 - 999 head 2.00%

8. Limitation of Liability

Elite Cattle Auctions, LLC (ECA) is a marketplace and venue. Our role is to connect buyers and sellers and to act as a payment agent. We do not guarantee the condition, health, or transport of any animal. All transactions are ultimately between the buyer and the seller. In the event of a dispute between parties, the decision of ECA is final.
